Here as promised is a quick synopsis of my conversation with Jeffrey.

$22,446 is to be wired to my personal account today:

Columbia debt of $59,933

Jeffrey said that he would take this debt on and pay it directly. He said he planned to try and negotiate the debt down. Is there a way that we can formalize that Jeffrey is taking on the responsibility to pay my student debt? I don't believe Columbia will allow me to simply assign the debt to a third party, so I remain legally liable to pay the debt until such time as the debt is cleared.

The Columbia University contact for my student account is Leah Young - I've already spoken to her to give her nermission to discuss my account with your office and she's evnecting a call. Her

a) Debt is from Spring 2010 (29,546), Summer 2010 (14,400) and Fall 2010 (14,400) for total debt of 58,346.

b) Tuition was for a 5 semester program which John has completed — he is currently enrolled in 1

- class for Spring 2011semester

c) Employer was paying for tuition however that stopped and John needed to find a new source to pay for tuition

d) Columbia allowed him to continue to take classes on his promise to pay

e) When balance became so large 58,346 Columbia helped him obtain Federal and Private loans

f) Loans were approved by Federal Government — Loan #1 $20,500 and Loan #2 $26,758 and Private Lender — Chase $31,283

g) Federal government has minimal credit requirements (no bankruptcies over last 5 years or tax liens) so John was able to obtain funds

h) Loans were approved and Columbia received funds on January 12, 2011 — I was told that loans were overfunded in the amount of 12,224 and these funds will be returned to lenders

i) I told Columbia that John will have to declare bankruptcy and they informed me that Federal Student loans do not get wiped out even if bankruptcy is declared by John

j) Since Columbia outstanding balance is now fully satisfied they have no desire to negotiate down balance and will not come after John

k) John will receive degree since debt is with Federal Government and Private Lender

I) I was told that the only blemish Columbia will receive is that their student loan default rate will

go higher which may impact their ability to get future aid for students

m) I have received another contact at Columbia to speak with tomorrow however I was told that

they have never eliminated tuition especially after being paid by federal government — I plan on contacting tomorrow morning as she is not in today

It sounds like the fact pattern you received from John may be different from what I just heard

Johnny O'Sullivan has called again asking if our accounting dept can please call Columbia re the loan. He says he spoke to his contact at the accounting dept at Columbia and she has still not rec'd a phone call. He also says that London keeps hounding him wanting to know if the issue has been taken care of. I told him last Friday that I had passed on the information to our accounting dept...please advise.

Johnny Sullivan — I wrote you note yesterday stating that when I asked him to return money last week he said he had understanding that after 22k and Columbia paid he would sign papers — should I press him for return of money or wait until I hear from him?

Just spoke with John O'Sullivan and he said that he passed on my request to send back 22k to Duke & Duchess.

He mentioned they were going to reach out to you and were surprised by my request to send back funds. They asked him to sit still for a few days until this got sorted out therefore he cannot send back funds just yet..

He stated that when you and John spoke on January 20th you stated you would send 2 wires to him and Columbia.

John is still contesting fact pattern.

I do not trust this guy as he is slippery and appears to be dishonest.

Just called John and he says he just spoke with Duke who told John that there was confusion over student debts.

I told him regardless of that I need funds sent back today

John told me that upon receipt of 22k it was used immediately to pay creditors and he does not have money to repay

I, have expressed my concern to you that despite all our concerted efforts I still remain unpaid. The financial arrangements have been agreed directly between the Duke, the Duchess and I for some 2 months. Yet from what I understand there is no plan in place to pay me the $59,933 I am now clearly owed. I agreed to reduce the amount I am owed by the Duchess in wages from $72,596 to $59,933 in order to reach an agreement with the Duke and Duchess. The Duchess then emailed me, twice, to say that my offer was acceptable to both her and the Duke. I did not waive my right to receive this money lightly given the debts incurred as a result of this non-payment and resulting struggle I have endured to try and support myself and pay for my MBA course at Columbia.

This is completely unacceptable to me and in conflict with the spirit of good faith by which I thought agreement had been reached. If I am not paid what I am owed, in full, by this coming Monday I will instruct lawyers. In that case I will also look at going for the full amount since my agreement to the reduced figure was given on the basis of a prompt payment. I hope it wilt not come to this but can give you until Monday 21st February 2011 to come back to me with payment.
