3/13/10 at 2200 hours, the same male from the disturbance on 3/5/10 returned. Report generated and forwarded to TWC and to client's house manager. Someone from the office might want to call AGW on Monday morning.

I believe the male lives at El Bravo Way and South County. He has no reason to drive on El Brillo Way except to harass our client through us. His car is parked in his driveway in plain view.

Tom, please pull up the first incident report and call me with the vehicle tag number so I can verify this information.

Re: Parking

Problem:

The same male is now calling in parking complaints on us at night and during the day. Daily, at 0800 hours we get permission from PBPD dispatch to park on the road in front of the client's address. On Sunday, 3/14, the male called dispatch at 1300 hours and filed a parking complaint. Dispatch called Capt. Turk and asked him to move TWC car.

Solution:

I called dispatch. They advised if we get parking permission on a daily basis AND a parking complaint is filed they will ask the owner to move the vehicle as a courtesy to keep the peace. The vehicle owner can refuse and the permission to park will remain in effect.

A better solution:

I talked to a PBPD police officer. He recommended a better approach. TWC can contact either the PD or code enforcement and request a permanent parking permit. It is normally used for construction vehicles while a house is being renovated but would apply to our situation. Once we secure a permanent parking permit, we can park on the roadway 24 hours a day with impunity.

Got your message yesterday, unfortunately it was garbled at my end. Please email the tag and any info we have so I can forward it to Donnie for his safety.

And I spoke to the client's house manager yesterday, We are currently parked in the space reserved for the client's girlfriend. She will be back in "several weeks". He did not give a specific date. When she returns, there is little room for TWC vehicle. Please let me know if the permanent parking permit is feasible. Anything Donnie and I can do to help, please let us know.

Officer Safety / Client Safety issue Suspicious vehicle: Late model Chrysler 300, 4-door, dark gray, Florida tag 493TCT. Driver: W/M, 25-28 yoa, black baseball cap, black jacket. Suspicious male; (on foot) W/M, 28-30 yo, 6'00", 180, black baseball cap, black jacket, black jeans, black tennis shoes w/ white soles,

On the way in tonight, saw a dark gray Chrysler 300 parked in front of 111 El Brillo Way facing the client's address. In 8 months there has never been a car parked on El Brillo Way. (red flag #1) Car was off, no headlights, W/M behind the wheel. As I slowly drove by, he looked straight ahead. Not normal behavior most people will look over at you as you drive by. (red flag #2)

Parked my car at the client's and opened the gate as if I was going inside to get the TWC vehicle. I stayed in the foliage and watched the roadway instead. A W/M, dressed all in black, walked off of Travers Way toward the client's address. I went inside got TWC vehicle and drove out. He was gone. Checked the area with my big-ass flashlight (including front and sides of the pump house at the dead-end). He was gone.

Parked TWC vehicle but left the brake lights on to illuminate the pump house. 30 seconds later the W/M came out from hiding behind the pump house. As he walked by me he tried to hide his face. I called PBPD and followed him until he walked southbound on South County Road. The Chrysler followed him shortly after. PBPD could not find either of them, I'm sure the Chrysler picked up the W/M and fled the area.

At 2238 hours, the Chrysler returned and parked in front of 111 El Brillo Way. He was driving blacked-out but I saw his brake lights illuminate the road behind him as he stopped. I called PBPD and went down and got the tag and description of the driver. He fled southbound on South County Road before PBPD arrived. PBPD told me the registered owner of the Chrysler is out of Pompano Beach and does not have a criminal record.

Either this is a private eye hired by the neighbor that is complaining about us or this is an attempt to surveil us by someone wanting to do harm to our client. In either scenario, they appear to be amateurs but cannot be dismissed as they are a clear danger to officer and client safety.

I notified chain-of-command via Capt. Lasso and filed a TWC incident report. I forwarded one copy to the office and one copy to the client's house manager. (Morning hours at the end of shift on 3/18)

Tom,

The cars seen at the Epstein residence belong to Richard Fandrey and Michael Fisten. Richard Fandrey is related to the Gambino family. He is the former bodyguard of Scott Rothstein and was employed by Scott Rothstein to harass Mr. Epstein. I believe you should make this known to the palm beach police captain that has responded to your calls. Scott Rothstein was moved from his federal prison cell as a result of wearing a wire and testifying against one of the Gambinos in Miami. You should make this known, as if there is a violent incident, the police should be on notice. We are concerned they may be armed and feel that the Palm Beach Police should be on some sort of pre-notice.

Spoke to Capt. Hess tonight. His department is still getting complaints from Michael Fisten (pretending to be a resident) in reference to our parking on the street using headlights. PBPD's solution is to have the client send a letter requesting the section of the roadway in front his address to be a parking zone and the city would remove the no parking signs.

I asked Capt. Hess if they knew the complainants' name or his address. They did not. I gave him Fisten's details, along with the other three miscreants information. Capt. Hess is now aware they are Pl's surveilling the address and Fisten is upset my headlights are blinding their night-vision equipment, making surveillance impossible. His calling in parking complaints is his solution to get us off the street and their surveillance back on track. Capt. Hess will email this information to his Major. The next time Fisten calls in a parking complaint will be his last.
