I reviewed the letter from USCIS re denial and it appears to be a denial based on the failure of the [ ] requested position for not being qualified as a Specialty Occupation. It does not appear to be based on any [ ] ineligibility of your sole proprietorship to sponsor an H-1B employee. Moreover, for what it is worth, Arda advised me that applications for H-lBs and O-1s are completely unrelated and the persons who handle them at USCIS would not have anything to do with each other. Given Arda's current track record, I realize that what he says does not hold much stock, but I thought you should mention it to JE.

Does JE want to go ahead with the O-1 for Ion under the circumstances? Ion's status is up tomorrow, so this application needs to be filed express mail today one way or the other. If JE is ok with filing, then you need to decide whether you will either not provide net and gross income figures, claiming that this is a new business and stating in the cover letter that 2011 gross and net income figures are not yet available, or whether you want to provide a ballpark estimate for Gross and Net income figures. If you want to provide ballpark figures, get them to Davis asap. I would try to get this to Davis Woo before you leave this morning, so he can take care of it. So I know you spoke to Je about ion..do you mind letting Davis know what to do? I haven't had a chance to call him..been running around getting ready to leave now on our way to airport heading to Cali. JE said we should put in cover letter that since its a new business figures aren't available yet.
