Hi a Here is the letter I received from Paul Cassell yesterday. I have already talked to him about it, and he is as intractable as always. He wants us [or the FBI, I guess] to waive its statutory protections and just turn over the "Black Book" to his clients.

I explained that, in my opinion, his clients are not victims of the crime that I am investigation, which is obstruction of the federal criminal investigation, not disobeying a civil subpoena, which wasn't even served by Cassell or Edwards. Victims don't have a right to get copies of discovery.

More importantly, my bigger concern is that I don't feel comfortable turning over names and telephone numbers of potential child sexual abuse victims. I explained to Cassell that I spent most of Sunday researching Florida's rape shield laws and I don't think I can turn over the book in accordance with that law. (This is the same concern that the FPD's office has, and it is why they have refused to take copies of the discovery.) Cassell's stock response is that the government's obligation is to put the victims where they would have been if the crime hadn't taken place, and if the butler hadn't obstructed justice by disobeying the civil subpoena, they already would have had a copy of the book. I said that was a non-starter for me because if the butler hadn't obstructed the criminal investigation, WE would have already had the book, and the victims would not have had access to it without going through the hoops of issuing a subpoena to a federal agency. I also told him that, since the butler stole the book from Epstein, taking Cassell's approach, we would have to name Epstein as a victim of the crime, too.

In the end, I think this will have to be litigated, but we should discuss the best way for that to happen.
