Hi Darren,
We would like to confirm the receivement
of the wire transfer for $91,250 (half of acceptance of bid). The Preliminary Design will be presented, as accorded with
Mr. Epstein, on the 13th of this month. We would like to know when will
the other half of the acceptance bid be transferred, since once the Preliminary
Design is presented, the initial acceptance bid and the Preliminary Study
‘fee’ will be due.
Regarding your questions
below :
- The estimated size of the project is 43,056 square feet,
or 4000 square
feet, which will be ajusted after the presentation
of the Preliminary Study.
- We don´t see any problems in using the USVI laws as the basis for
the contract, but we´re waiting for further information from a legal
representative we´re contacting in the US.
- OK.
- The development of our contract regarding stages of our project, we
based our on previous experience with international projects, and Mr.
Epstein´s hurry for the initial agreement. Now that we understand
the complexity of the project in the USVI, we are analyzing the best way
of developing the project. We are contacting consultants in the US
that may help us in achieving the best results, and we try to present this
idea on the following Friday.
- Ok.
- Not yet. We are searching for the best way to deal with this
issue.
Please find some of our
doubt below :
- Although we asked for the building codes for the USVI, we didn´t
receive any regulations regarding landscaping and construction in the
Little St. James. Thiago understood that Mr. Epstein didn´t want the
designers to worry about these regulations, how should we proceed?
Since the preliminary design is already being executed, we worried
about concluding this phase without these regulations.
- Is there a specific construction management firm that works
for Mr. Epstein ? Should we suggest an American firm for this
job ?

Subject: Little St. James
1. Please
confirm your understanding of the total size of the project. Your draft indicates
4000 meters
or 13,123 feet.
Is this what you base your fees on?
2. I suggest
that USVI Law should govern the contract because the work is done for a
project in the USVI
3. I suggest thatUSVI
should be the forum to resolve any disputes, especially if it is applying USVI
law.
4. I suggest that we
clarify payment stages in the Preliminary Design and Executive Plan Stages to
account for initial presentations, comments, revisions based on comments, and
final approval. At the preliminary stage there should be a list of actual
deliverables that comprise the Preliminary design. One of the
deliverables of the Preliminary Design should probably be a list of
deliverables for the Executive Plan stage.
5. All moneys due
should be paid by wire transfer and we will need wire transfer instructions to
include in the contract.
6. Will your firm
obtain USVI license?
Other comments to follow.
