CONGO 14E65: I have tried many times on Friday and this morning to reach David Wolf (212-974-7474) the attorney for the Congo....he has not returned any of the calls. I have just spoken with his agent, John Farrell of Helmsley Spear, who has also been trying ( to date unsuccessfully) to get in front of Mr. Wolf to determine how (or if) a deal can be put forward. John says that in addition to "liens" he has been told that there is some threat of an "international lawsuit" if the Congo leases the building. He further states that he understands that Wolf has told the Congo that they will open "a Pandora's box" by leasing the building. This appears to be a messy situation with no clear path to a deal.

NARRAGANSETT 540 MAD: I have received a call from Anthony Dattoma asking about the status of the LOI. I told him that as far as I know Darren Indyke has received a mark up of the LOI that he sent to Sullivan and Cromwell on Friday but I do not know what has transpired since.

PH 485 MAD: I spoke with Jonathan Dean this morning. The only hang up with the deal that they were about to "shake hands on" is that the prospective tenant needs to get occupancy by June 2007 and Resnick may not be able to guarantee such date.

Please speak with Jeffrey Epstein about the direction we are to take in connection with the above....especially 540 Madison....since there is a ticking clock here.
