Dear Mr Epstein,

Following your email of today, I would like to go back on the following points:

    • Concerning the forest and the corresponding maintaining obligations;

Two differents types of obligations :

i) The owners have been allocated of a substantial amount of money (about 50.000 EUR) from the french administration after big storms in 1999 and 2004 put numbers of trees down.

In exchange of that financial help, they commit themselves to clean the forest, to plant trees and other side obligations (interdiction to split parcels, to change the exploitation of the soil etc.).

The current owners must maintain the quality of the forest pursuant to the abovementionned agreement for 15 years (ie: until 2019). If not, the current owner (or the future one) will be compelled to reimburse the allocation with a penalty of 25%.

ii) Moreover, the current owners benefited from a substantial tax relief of 75% for estate tax when their father passed away. In exchange of that tax relief pursuant to article 793 and 1840 G bis of the French Tax Code, they accepted to sign a managment plan for the forest. This plan is applicable for thirty years (up to 2036) and guaranteed by a lien on the property to the benefit of the french tax administration. The cost for the maintenance of the forest in its current state is not known yet although the figures should be given to us soon.

The works on the forest are externalised to an expert called Mr Jean d'Harcourt. He will provide us with more details soon including a plan of the parcels concerned.

The obligations resulting from that plan are automatically transmitted to the successive owners for thirty years.

    • Concerning Tax on the property:

The land tax for 2006 amounts to 7.132 EUR according with the documents provided to me.

An other tax called inhabitation tax also applies but we do not have any information yet.

    • Concerning the neighbours activities

You can certainly go on their website (http://www.joubin.fr/htfr/0026.htm) where you can get information on the type of events they make and eventually make your mind to see whether such activities can be considered as prejudiciable for you.

  1. Finally be aware, that something new has come up today about a potential water source to which the chateau would be linked. An official deed which gives the main rules and obligations toward the property where the source is located apparently exists and is enforceable since the 16th century. That document also called "easment deed" should be provided soon by the sellers counsels.
