I think Max is the one who needs to determine what his resp=nsibilities as a trustee are. I can't advise him as that wou=d be a conflict of interest with my representation of Noam. I can, h=wever, advocate for Noam and urge Max to be more liberal with regard to di=tributions. I can also let Max know that in my view he is not requir=d to confer with Harry when making his distribution decisions. Not o=ly is he not required to confer with Harry, doing so gives Harry a voice t=at the trust prohibits him from having. Perhaps I should give Max a =all to explore why he believes he needs to get Harry on board with the dec=sions, and that might help the situation. I can also write him a let=er with regard to my interpretation of the trust terms. All he is re=uired to do is to consider the interests of the remainder beneficiaries, n=t obey them. I agree the whole thing is a bit odd.
