He has to accept responsibility for all of the lies. If the lies did not happen or did not matter or were not persuasive, then the conclusion is that I was much worse than stupid: I was/am pathetic.
In the fall of 2001, Enron stock was in free fall. The employees of Enron were terrified that they were going to lose their life savings: for many, 90+ percent of their 401ks and pensions were invested in Enron, as encouraged by the senior executives of the company. Ken Lay called all of the employees together and reassured them, telling them that the fundamentals of the company were strong. He then imposed a lock-out so that none of the employees could sell Enron stock. What he told the employees were flat lies, but almost all of them trusted him. You know the end of the story...
The point is that the employees probably should have known earlier that the company was in serious trouble, but they trusted. Should they have done more to protect themselves? Yes. But he intentionally deprived them of the right to make their own choices based on complete and truthful information. That was wrong. That was criminal.
This is basically a version of the summation I gave to the jury in 2006. I did not expect to be making it again in 2015.
