He was correct. It is not under oath. It is subject to felony prosecution for making a false statement under 18 USC 1001, which is more significant than being under oath.

i understood that, however what she told the fbi was the truth, and she lied under oath, can her voluntary testimony to the fbi with no transcripts or sworn statements be used as conclusive evidence of perjury. where a contradictory sworn statement would be easier
Who did she lie to? Congress? I don't think she did. The investigation concluded that she didn't intend to mishandle classified info, so her statements to congress were consistent with her state of mind. Just because the FBI found things that were inconsistent with what she said doesn't mean she lied -- only means that she was mistaken.
