Our client understandably finds your allegations deeply upsetting. She has already had to endure many years of pain whilst coming to terms with the abuse to which she and her sister were subjected, and your false allegations have only served to exacerbate her trauma and suffering in this regard. Mr Tonks is unable to provide any first-hand evidence in relation to the abuse our client endured and his previous actions, as described above, make him a highly dubious witness in any event.
Resolution
Our client is entitled to seek substantial damages for the injury to her reputation, in vindication of her good name and to compensate her for the distress and injury to feelings she has suffered in consequence of your unlawful conduct outlined above. She is also entitled to seek injunctive relief and/or a compliance order under section 167 of the DPA requiring your removal of the offending statements and to refrain from making the same, or similar, statements in the future. The injunction would also prevent you from otherwise harassing our client and she would be entitled to an order requiring you to publish any judgment finding that she has been defamed. Finally, our client is also entitled to seek her legal costs from you.
Notwithstanding our client's unquestionable entitlement to the remedies mentioned above, her primary concern is to ensure that any content that you have published about her which remains online is removed immediately, you retract and apologise for what you have done, and your unlawful conduct ceases forthwith.
