examples of how the rue==les have changed,,, i.e.
1999, people that plead nolo to...., to not incur the
risk of trial find themselves

We can make the point we discussed on the phone by
substituting this
paragraph for the final paragraph of the memo that
I sent you.

           Thus, if the defendant pleads

guilty to aggravated

assault, there is a grave risk that under existing
state and Virgin
Islands statutes, he will be subject to sex
offender registration
requirments and/or criminal exposure for failure
to register. There is a
graver risk still that there will be future
expansion of the statutes or
expansive construction of them that will mean he
is covered or arguably
so. Many people who pled guilty to offenses when
no registration
requirements existed have been surprised to find
themselves subjected to
registration laws enacted or expanded after their
guilty pleas were
entered. The defendant should not have to live
with that Sword of
Damocles hanging over his head.
