Dear Mr. Indyke,
I am in receipt of your letter to Mr. Fix of this date.
It is with particular ill grace that you are trying to suggest that Mr. Epstein claims "surprise" at our being angered by his (and your) misconduct today. Rather than seeking to build a misleading record for yourself, have Mr. Epstein explain, in writing, why after months of his assuring us that he was supporting our efforts to eject BSAM and install FTI Capital Advisors as General Partner of the HGEL Onshore Fund--assurances we relied upon to develop a strategy at enormous expense--the morning of the vote he did a 180 degree turnabout and refused to vote for FTI, thereby ensuring a loss for them--and us.
Pending that explanation I will refrain from voicing some of my own suppositions, but put you on direct notice now that we are reserving all rights and claims for the damages you have caused us.
