As I see it the following is the summary of the situation. Though I required girls over eighteen, the results don't reflect it. . .. The feds have spoken to , or know of ,girls between the ages of 16-18.IF we extrapolate from tatum and haley we should assume that there are 20 girls in that age range. , they will all claim topless massage ,plus.,that's the bad news. the difficulty for andy, will be they will say they knew what to expect,, many , but not all will admit to lying about theirr ages. alex , tatum and haley will tell similar stories regarding payment, but tatum and haley will also tell them the truth about the age representation. the age of consent in florida is 18, the federal age of consent is 16. however this is not an age of consent issue, it could fall under "commercial sex activity" with a person under 18. The federal law, even though theoretically makes it a crime for a college student 17 to travel to another state to have sex with his girlfriend,17, if
he buys her a dress as a present the facts fit. even though the state ages could be both 16. the three relevant statutes 1591 2422 , and 2423 , each present their own problems for both sides. 2422, requires" knowingly", using the phones to entice.... they have sarah on the phone , talking to a girl, who we have already met face to face. they could argue , "to schedule is enough, sarahs knowledge they would have to disregard, and make her my instrument, . 2422 is an attempt crime. so no actual sex needed, but a an intent , with knowledge ,to have sex, or commit a state sex crime would be enough. Having a knowing intent ( age and action)to have digital penetration with a 16- 18 yr old. They could claim that haley , tatum or alex used the phone on my behalf,, ( now, more difficult). for 2423, the travel statue, the purpose agrgument would have to be watered down, tied to a specific phone record recollection ,and subsequent trip. With so many girls admitting to lying
about their ages, a difficult case to win , but if nothing else, bring. . (NOTE under florida law a girl ned to be 18, to get a peircing without parental consent, , I remember when questioned a girl used that answer of proof of age. Tatums fake drivers licence seems to be more common than I expected. ) 1591 travel and prostituion, also a stretch,,Private prostitution?, /. Andy needs some type of out.. He sees young girls in large numbers,, no sex, but bad conduct. bad witnesses, but many of them.. If it were a bar case they would say that the bouncer was reckless. and take away the license and fine them. However if the percentage of underage was huge, they would assume a scheme to attract them. Andy's view of the state 's incompetence will be bolstered , but this case is clearly a state case.. No victims , no sex , no coercion, no position of authority, the state never bringing a touching case, will only go so far into alleviating his concern for the numbers , the
wealth ,and I'm sure in his view ,the targeting of minors. Our argument has to be more than, I targeted over eighteen , but my aim was off, .WE need to craft a solution. I am concerned that Andy will take the chiefs view that this is a bad guy,, even if we can't make a case, let's bring it to punish him.. with regard Alex halls age, I remembered that she told me that she was in pre-med when I first met her, and I bought her a book on pediatric oncology. Other gifts to other girls included paying for nursing school, down payment on a house, hair cutting school, ged , lessons, all for girls in their twenties. baby gifts , etc.
