Dear ISTAT Member, The United States Federal Aviation Administration (the "FAA") has published proposed changes to its regulations issued under Part 47 relating to aircraft registration. Under its proposed new Section 47.40, all presently issued certificates of aircraft registration, and all newly issued (and all re-issued) certificates, would have a three year expiration date. If the registration certificate for any aircraft is not renewed within 90 days of its scheduled expiration date, then registration of such aircraft would expire. If enacted as proposed, the proposed rule could have significant adverse consequences for ISTAT members, including difficulties with maintaining proper title on leased aircraft and loss of a perfected security interest in mortgaged aircraft. The FAA is accepting comments to the proposed regulations through May 28, 2008. If you would like to submit comments, we suggest that you do so individually or through any industry group of which you may be affiliated (such as ELFA or IATA).
