Just got a chance to open e mails. The response is Yes subject to the following:

 

  1. I had a physical problem which cost me some time at work and affected my mobility over the past week so I could not personally meet with DPNR to get a clear picture of permit status and I lost a couple of days on this project; I hope to go to DPNR tomorrow if I can convince my wife to let me drive a car.
  2. The agency has been under a microscope from the staff review teams assigned to evaluate agencies by the incoming Governor; I hope that this distraction does not disturb the pace of the agency reviews.  
  3. The design reviews of the indoor pool expansion produced comments and changes which have to be incorporated into the final drawings to be used for building permit purposes.
  4. This process apparently awaits some further approvals of the pool which Mr. Molyneux is discussing with Mr. Epstein.
  5. I personally visited Aercon on another project two weeks ago to investigate the possible use of air entrained concrete panels which would reduce the amount of concrete used in the project; that review was very positive; the Aercon engineers are now in direct communication with Maguire to see of the panels can be used in the indoor pool expansion.
  6. The schedule which I sent Mr. Epstein last week records all of these events.
  7. Some engineering bills are becoming due; I thought it timely for us to prepare a master budget of all activities which I intend to review internally tomorrow for distribution so that Mr. Epstein or his staff can track actual and projected project expenses.
  8. We are assembling construction personnel and starting buy out for the office construction and are very much in need of an overall contract; I will send Darren a fresh draft tomorrow which may help clarify the relationships.

i take the liberty to summarize the high points of our conversation.
 
  1. we have offered to discount our october ($26,340) and november ($17,031) bills by 50%.  you accepted and offered to have them paid right away.
  2. contract:  we need one asap in order to proceed with managing the work.  (we agree on this)
  3. contract issues;
  4. a) i proposed to reduce our fixed profit on the cm contract from $3.0m to $2.8 m.  it would be billed in equal monthly installments over the 36 month term of the project.  at the end of the project, if you are happy, you pay us the additional 200k. i said i would channel this to our people to provide personal incentives for performance.  if you are not happy, you don't pay the 200k. b) for portions of the work that one of our affiliate companies might bid for, those bids will be lump sum, not subject to any limitation on mark-up.  as construction managers, we would seek competing bids from other qualified subcontractors.  we would analyze the bids and scopes of work and present them to you (or your designee) along with our recommendation for award.  you would decide to whom the work should be awarded. 
  5. we will prepare for your review an up-to-date budget of the office building.  it will include the various subcontractors and vendors selected and engaged by the architect that we have been given.  tuesday art is traveling to stt and i am returning from florida to maine.  we propose to deliver the estimate to you wednesday.  art would sit with you in your office and i would be on the phone.  we would review the estimate to your satisfaction.  at the end of that review, we will finalize and execute a contract for construction management.  if you remain unhappy with our work after that review, we will bow out of the project.
  6. we will try to find out what the coconut wall is.
in additon there are 2 things i want to advise you of:  1) it is absoultely critical that you engage on a contract basis the services of the maguire group to complete necessary engineering work.  failure to do so will delay the work.  2) art has set up a conference call tomorrow morning to kick start things.  see below
