=I have spent the beginning of the day working out an approach to the intake line and dock which is as follows:
1. ACOE has taken one step which has been to assign our case to Vivian Gerena; our case had been assigned to a Mr. Cedeno who had transferred to the States and his departure had contributed to the void.
2. Amy Dempsey has a fixed appointment to meet with Vivian Gerena on Wednesday; that meeting is for another client; it involves settling a violation; counsel for the party and for the ACOE will be there.
3. At that time she will arrange a conference call among Vivien, myself, and Amy to set up a separate session on our project.
4. We will ask that counsel be present for that session because we want to settle the violations, reach a conclusion and get an agreement patched together.
5. I hold a license to practice law here and in DC, Maine, and Massachusetts so I can appear on behalf of the principal as an offer of the company and counsel (any tentative arrangement involving outside counsel and DKI in accordance with whatever plan he approves)
6. I suggest that I independently call counsel for the ACOE in Puerto Rico asap to suggest this plan, ask for comments, and, lawyer to lawyer, try to get he or she into the loop
7. My fingers are crossed that the combination of an approach to counsel, which I will make today, if ok with DKI, and Amy’s efforts can and will do something more effective than my sitting in an office tomorrow hoping that someone will speak to me.
8. In this connection the quickest solution, in my view would be to settle the violations and deal with the pipe line, the expense of which will involve, in my view, planting mangroves in the north pond and more work on the west pond.
9. I did find out finally who did a study which purported to conclude that the north pond was a retention pond, not a wetland: the Williamsburg Group of North Carolina, a sub-consultant to Springline at the time; I will seek that report from them; I will discuss with Darren the issues that that report, if obtained poses for us.
On a separate note DKI has confirmed that JEE will be coming to the island until at least December. I called Doug about this last night and left a message. I think that we should plan the start of construction with this schedule in mind. We can talk about this on Monday.
I will speak to DKI about this note when he gets in this morning in order to get authority to proceed with this plan.
