CASE NO. 502008CA037319XXXXMB AB ORDER REGARDING NON-PARTY TOWN OF PALM BEACH POLICE OFFICERS' MOTION TO QUASH SUBPOENAS AND/OR MOTION FOR PROTECTIVE ORDER AND DEFENDANT EPSTEIN'S MOTION TO COMPEL This cause came before the court upon cross-motions, Non-Party Town of Palm Beach Police Officers' Motion to Quash Subpoenas and/or Motion for Protective Order and Defendant Epstein's Motion to Compel Town of Palm Beach Records Custodian's and Police Officers' to Produce Records Sought Pursuant to Defendant's Subpoenas Duces Tecum, and the Court having heard argument of counsel and being fully advised in the premises, it is hereby ORDERED AND ADJUDGED that said Motions are granted in part and denied in part. Detective Joseph Recarey shall obtain from the relevant service provider(s) all available itemized records for official or personal cellular telephones used by him from January 1, 2004 to the present. In the meantime, counsel for Epstein will provide Detective Recarey's counsel with a list of telephone numbers of those individuals that counsel for Epstein has in good faith identified as witnesses, Plaintiffs or other third EFTA00724305 parties related to the Epstein investigation and will identify the name of the individual associated with the particular telephone number provided. The names of minors may be abbreviated in accordance with prior procedures used in this case to protect the identities of those individuals. Detective Recarey and his counsel are directed to cross-check the telephone numbers provided by Epstein's counsel against Detective Recarey's available cellular telephone records and will serve on counsel in this case a statement identifying the date, time and length of any calls from or to Detective Recarey's cellular telephone or to or from the telephone numbers provided by counsel for Epstein. The Court reserves ruling on requests No. 15 of Defendant Epstein's subpoenas duces tecum to Captain George Frick, Detective Michael Dawson, Detective Michael Pagan, and former Chief of Police Michael Reiter. However, those individuals will not be required to obtain or to produce any information regarding their cellular telephone records at this time.
